HostBlink Hosting - Terms of Service November 2007
1. Opening a Hosting Account
Opening a Free Hosting Account: To be eligible for a free hosting account you must read, understand and agree with this TOS and you must be 14 years old and above to use our services.
Operning a Paid Hosting Account: To be eligible for a paid hosting account you must read, understand and agree with our TOS and you must be 14 years old and above to use our services. You must also have a Verified Paypal account to pay for the hosting.
2. Applying For a FREE Hosting Account: Only 1 account per person. Anyone found violating this term will have their account terminated immediately.
3. Content: Any website content that is against HostBlink TOS or supports illegal activities will result in instant deactivation of your hosting account. Any Pornographic Warez, or Racist or anything along those lines is also prohibited.
Free Hosting Clients must have their site up and running within 24 hours. All empty free hosting accounts will be terminated 24 hours after they signed up.
4. Spam: Sending unsolicited emails to people who you don’t know via HostBlink email account/server is not permitted. Offenders will be investigated and will result in Account Suspension/Termination.
5. Scripts: IRC Chat Room, nulled or unlicensed commercial scripts are not allowed.
6. Files: mp3, mpg, divx, wmv and other variants of files are not allowed due to possible copyright issues. You are not permitted to upload ANY software that was made by others to your site (e.g. MSN Messenger, FireFox).
7. Support: We offer 24/7 Friendly Forum and Official Ticket Support.
8. Checks: All HostBlink Hosting Accounts are being subject to regular check and scan, including hidden and suspicious files to maintain the quality and security of our servers.
9. Abuse: Abuse such as using another’s webspace and hacking other HostBlink sites will not be tolerated.
10. Contact Details: These must be correct upon application. We use as the main contact option for your hosting account.
11. Required Files: Please leave files that come pre-installed in your account.
12. Backup Policy: - We do nightly backups and weekly offsite backups on Sunday however we make no guarantee that we’ll have a backup for your account. We will make every attempt to restore a backup of your site however we encourage you to do your own backup. We will not be responsible for incomplete backups and do not provide any compensation in the event that the backup is not current. It is YOUR responsibility to backup your files.
13. HOSTBLINK SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY INDIRECT, INCIDENTAL,SPECIAL OR CONSEQUENTIAL DAMAGES, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF USE, OR LOSS OF DATA RESULTING FROM THE USE OF HOSTBLINK’S SERVICES BY CUSTOMER OR ANY THIRD PARTIES, REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY, OR ANY LOSS OF DATA RESULTING FROM DELAYS, NONDELIVERIES, MISDELIVERIES OR SERVICE INTERRUPTIONS.
14. HOSTBLINK PROVIDES THE SERVICES AND PRODUCTS AS IS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. HOSTBLINK DISCLAIMS ALL WARRANTIES OF NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS, AND DISCL AIMS ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CUSTOMER SHALL BE SOLELY RESPONSIBLE FOR THE SELECTION, USE, AND SUITABILITY OF THE SERVICES AND HOSTBLINK SHALL HAVE NO LIABILITY THEREFORE.
15. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTBLINK DISCLAIMS, ALL WARRANTIES, REPRESENTATIONS OR OTHER ENDORSEMENTS, EXPRESS OR IMPLIED, WITH REGARD TO THE INFORMATION ACCESSED FROM, OR THROUGH, THIS SERVICE, THE SYSTEMS WHICH PROVIDE IT, AND THE INTERNET, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE, OR NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS.
16. HOSTBLINK DOES NOT ASSUME ANY LIABILITY FOR THE COMPLETENESS, ACCURACY, OR USEFULNESS OF ANY INFORMATION DISCLOSED OR MATERIALS ACCESSED THROUGH ITS SERVICES, ITS SYSTEMS, ITS NETWORKS, OR THE INTERNET.
17. No Waiver of Rights by HOSTBLINK.
Any failure by HostBlink to enforce this Agreement in every instance in which it might apply does not amount to a waiver of any of HostBlink’s rights.
18. Notices - HostBlink will keep it’s customer updated with service changes via Email. Customers must provide a valid updated email address.
19. Account Termination/Cancellation: HostBlink reserves the right to decline your hosting request for any reason at all. HostBlink may also terminate your hosting account at any time without any prior notice if you did not comply with the hosting rules. However, 7 days notice given for account termination in other circumstances.
YOU MUST AGREE to these Terms before applying and purchasing hosting.
